City of Brampton Strengthens By-Law to Prevent Overcrowding and Enhance Housing Safety

New Amendments Set Occupancy Standards and Increase Penalties for Violations

BRAMPTON, ON – The City of Brampton has updated its Property Standards By-law 165-2022, introducing stricter occupancy standards to prevent unsafe overcrowding in residential dwellings. Effective January 22, 2025, these amendments establish clear bedroom size requirements and increase penalties for repeat violations, reinforcing the City’s commitment to affordable and safe housing.

  • For bedrooms housing three occupants, a minimum total floor area of 14 square metres (approx. 150 square feet) is required. This aligns with Ontario Building Code standards for dormitory-style accommodations.
  • For bedrooms housing four or more occupants, a minimum of 7 square metres (approx. 75 square feet) per occupant is required.
  • To deter violations and enhance enforcement, the City has introduced increased fines for those who repeatedly breach the by-law:
  • First offence: $500 (unchanged)
  • Second offence: $750
  • Subsequent offences: $1,000
  • The by-law continues to prohibit converting living rooms, dining areas, or other spaces into bedrooms without a valid building permit. These occupancy standards apply to all residential properties in Brampton, including houses, condominiums, and apartments—whether owner-occupied or rented.

This amendment responds directly to community concerns about overcrowding while ensuring cohabitation remains safe and sustainable. It is part of a larger City initiative to address housing challenges, protect tenant rights, and enforce responsible property management.

The City will continue to monitor and evaluate these regulations and may introduce further amendments as needed.
