Lawsuits Filed Against Delta Air Lines and Endeavor Air Following Crash-Landing at Toronto Pearson

Passengers Seek Compensation for Injuries and Emotional Trauma After Fiery Incident

Delta Air Lines and its subsidiary Endeavor Air are facing multiple lawsuits after Flight 4819 crash-landed at Toronto Pearson International Airport, injuring 21 passengers.

Minnesota resident Hannah Krebs has filed a lawsuit through Motley Rice LLC, citing negligence and failure to follow proper landing procedures. She claims she suffered severe injuries and emotional distress after being violently thrown around the cabin when the aircraft overturned.

A second lawsuit was filed in Georgia by Texas resident Marthinus Lourens, who alleges serious head, neck, and back injuries. His complaint states that he was drenched in jet fuel while suspended upside down before assisting in the evacuation.

In Canada, a Toronto-based legal firm is exploring a potential class action, as more passengers seek legal representation. Under the Montreal Convention, affected passengers may be entitled to up to US$200,000 (CA$284,000) in damages without needing to prove Delta’s liability.

Delta previously offered $30,000 to each passenger as a goodwill gesture, but lawsuits argue the airline’s operational failures and crew errors caused the crash. The Transportation Safety Board of Canada (TSB) is investigating the incident.
